saying that the chief is working with his command staff to address the issue. judge cordell will officially release her 182-page report to the san jose city council and the mayor one week from today. live in san jose, marla tallez, "today in the bay." it is 6:02. the allamet da sheriff's department will no longer patrol the streets of oakland. the two departments can't come to an agreement. the chp did extend their contract with oakland. the chp did that. under the new terms, the chp will be patrolling the city as many as four days a week. the new agreement will go before the city council for approval on may 7th. 6:03. a prominent defense attorney nighting to key her law license after being accused of smuggling a hit list out of jail. state bar of california will argue here in san francisco today that attorney, lorna brown, should be disbarred for smuggling an alleged hit list out of an east bay jail on behalf of her client. having something like this happen is pretty rare. less than 1% of the state's attorneys were stripped of their licenses in 2011. according to the chauncey bailey project, attorney brown admitted she took notes from him while he was in jail. she said she thought they were love letters to a girlfriend or other notes intended for his mother. bay was a former leader of your black muslim bakery in oakland. he was convicted of ordering murders of three men. she said she passed the papers but it was a list against bay. no witnesses were harmed. brown agreed to a two-year

suspension. that suspension was rejected by the supreme court of california. the new trial will determine what punishment is right under the circumstances. >> reporter: reporting live, christie smith, "today in the bay." the surviving boston marathon bombing suspect says he and his brother were motivated by religious views and not by terrorist groups. dzhokhar tsarnaev is communicating through notes. the attack took three lives and injured 170 people. san francisco's police wants more cameras to monitor the city. he is asking for cameras up and down market street. the main thoroughfare is the

right now, 58 degrees in san francisco. much warmer inland out towards livermore, 55. 56 in san jose. in santa rosa, napa and livermore, 20 degrees warmer than 24 hours ago, all because of the winds which have been fairly strong out of the north and to the north bay and east bay hill tops. wind advisory out of fairfield. you can see the differences in terms of the dry air in the hills with the breezy conditions. a little bit of cooling on the coast. past lunchtime, the temperatures starting to warm up. areas in orange showing low to mid-80s inland. mainly 70s around the inner bay. cooler air punching inland out towards livermore. today, still 80s inland. morning miss the and more fog inland across the bay area. folks at bay bridge toll plaza, the metering light is on and in full effect.

just about 6:00 is when it happened. look at how quickly. just over five minutes of backup, already back past the 880. no surprises. the arrow marking the east shore freeway. very nice flow. pretty light coming down off of that richmond bridge. it will start to build dramatically over the next half hour. reports of a crash. it sounds like a hit and run. no major injuries. that may be a distraction for folks. we don't need anything worse for 580 westbound. 8 h 84 as you are heading down. over towards valacitos. both directions approaching sunol. approaching that freeway. we will see sunol build heading down into fremont. a live look farther south for 101 off of 680. the volume building here for san

caught fire after the bomb went off. >> 350 houses in the town of west texas have limited electricity and gas after the massive fire and explosion at a fertilizer plant could take weeks before water is restored. president obama will attend the memorial service for the 14 victims of the fire tomorrow at baylor university. a two-day hearing begins today on capitol hill regarding boeing's 787 dreamliner. the national transportation safety board expected to focus on the design, testing and certification of the dreamliner's battery system. >> 6:13. president obama says he supports an internet sales tax. scott mcgrew joins us now. a lot of people are really confused about what this means for them. many californians, they pay sales tax when they buy online. first things first. you are always supposed to pay sales tax no matter what. you are just supposed to self-report and few people do that. you are absolutely correct.

when californians buy something on amazon or best buy, those companies already include sales tax. so the senate bill would empower states to collect sales tax from any online purpose. ebay is one of the few companies against it saying it hurts small business. the law as written would exempt companies to do less than $1 million in sales outside their home state state. small business seems a bit bigger than you might have expected. there are lots of reasons not to like taxes. bottom line, in many cases, you were already paying them. in every case, you were ez spoed to supposed to be paying them. states and cities could collect $22 billion in new tax. the big business storiry y is g to be apple. investors are in a bad mood. no matter what the quarterly numbers are, do watch for apple to be pessimistic about business going forward.

a strategic move by apple to push expectations down ward. netflix is now bigger than hbo. more subscribers. also, for an extra fee, the company says it will allow four simultaneous streams in your house, four tv sets or computers or ipads or whatever, all watching different movies. netflix shares on a terror of 25% after hours. we expect $215 a share. remember, back before qwickster, much higher than that. >> it is in a positive direction? >> yes. >> they will take that compared to where they have been. thank you very much. 6:15 right now. we can safely say the future of flight is upon us. a plane that needs only sunlight to fly is taking off in less than an hour for a little test flight across the bay area. >> you can see it. the pilots are there. they can only get one at a time. he will be doing the test flight. you have to go very wide when you want to look at this airplane. it's wingspan is wider than a 747. one reason why it is so wide, you have all the solar cells that are going to be powering it. it will have 12,000 solar cells that allows it to fly, not only during the day but at night on batteries that have been charged by the sun. it only travels about 40 miles an hour. if you can imagine, they are going to try to do this cross couldn't interest i flight. it is going to take up five legs, 24 hours, nonstop, each leg, as we've been saying all morning long. yes, it would be possible for the plane to fly from san francisco to new york city, the

final destination. of course, one man by himself can not stay awake that long. they are going to leave here at moffatt field. they will be landing tonight. during this flight, you can see the airplane. it will be flying around 3500 elevation. it will be flying over the golden gate bridge around 3:00 and over the bay bridge between 6:00 and 8:00 tonight. in the past, we have heard from the creators of this plane. one reason why they are doing this, not only to see if, "a," it can be done. it can be done over europe. they also wanted to try to inspire science to improve solar technology so you could, in kt f fact, have an airplane that would be able to do this in a commercial sense.

they are trying to inspire that. there, you have it. he is right now. burtrom is in the cockpit. they are going to do some pre-flight measures. four electric motors. less horsepower in this airplane than there is in a vespa scooter. it explains why it can only travel ruffle 40 miloughly 40 m. it will fly without expending one drop of fuel. it relies completely on the sun. it will be heading in a north therl direction ov northerly direction toward the water. 3:00, over the bay bridge. 6:00 to 8:00 -- i'm sure. 3:00, over the golden gate bridge. 6:00 to 8:00, over the bay bridge. reporting live on the beautiful

runway, bob redell, "today in the bay." >> that is pretty cool. sunny today. what about the visibility? pretty good for that? >> that is one of the places not seeing too much wind. clear skies and warm temperatures. still plenty nice. a little further south to san jose. you are looking at the pretty sunrise view off to the east. clear skies in san jose. interesting temperatures this morning as we are seeing a battle between two different types of air, dry air coming in from the north bay and into the east bay hills with some north winds and coom marine air trying to work its way up the coast. we have some fog, mainly south of san francisco down towards santa cruz. inland, gusty winds around fairfield and napa really bringing in this dryer air. as it drops in elevation, it warms up and dries out. we call it compressional warming. you can see what it has done to the humidity levels. vastly different from in the teens which would be high fire

danger, let's say, about two or three weeks from now as things continue to dry out in the hills. in the morning, typically, you can see out towards oakland and san jose, not too bad in terms of the humidity. very dry in the hill tops. locally, windy inland i should say. coastal fog. 70s and 80s out around the bay. mid-80s inland. more cooling as the sea breeze is going to win the battle between the north winds and those southerly winds coming up the coast this afternoon. high today, away from the 90s. 80s inland near san jose south. low to mid-80s for highs. 85, pleasanton. 70s back over toward the east bay. 72, san francisco. later today, we'll watch for the low clouds trying to move in from the golden gate or under the golden gate as we head into tonight. all signs reporting to a cooler forecast. much cooler by the time we get to thursday and friday.

we were 90 in some spots yesterday. >> here is what i'm noticing. yesterday and today, we have seen traffic start about the typical time and not kick in until much later in the morning commute. that's what we are seeing. two days doesn't really make a strong pattern. that's what we are seeing right now. north 101 from 680 up towards 880 still. the worst of the slowing. a shark's game versus the dallas stars. we are talking about the morning traffic in the evening at 7:00 p.m. a smooth flow of traffic for the freeways. one incident reporting roadway hazard, 280 at the lawrence expressway. lawrence expressway and down that expressway, showing a little bit of slowing for the larger surface streets. a nice, smooth, south bay flow right now. as we take you to some slowing, 580 continue to build. it is holding pretty steady over

the last 20 minutes. no problems at the dublin interchange. the earlier hit and run sounds like it is not causing a problem. we don't see the censors slowing at all. 84 continues to build here. 680 starts to slow down. a good, strong build through pleasanton in towards fremont for that south 680 commute. oakland, lighter volume of traffic. this is north past the coliseum. there are no incidents or roadblocks or any closures to cause any slowing coming northbound. that's the volume heading north past high street. at the limit for 580 and 880. we saw the toll plaza backup there. for us that don't always travel through there in the south bay, we have a smooth drive in. the bay bridge toll plaza looks horrible. the east shore freeway is still moving smoothly. look at all this spacing coming off that bridge. the bridge itself over from the north bay, no problem.

and his brother acted alone and were motivated by religious beliefs. tracie potts, live in washington, d.c. >> lots of questions about whether he should be prosecuted as an enemy combatant, whether this could affect immigration reform. we will talk about that. we are learning a lot from those charging documents. the details of what's expected to be that. prosecutors think this prosecution has a lot of evidence. late this afternoon, members of congress will learn more about the investigation in a closed briefing but some are already questioning why dzhokhar tsarnaev won't go charged as an enemy combatant and whether it will delay immigration reform.

live look outside. san jose in the south bay. sun is up. going to certainly heat things up today. warming out there. rob mayeda is in for christina loren telling us what to look at outside. temperatures are the same. we have had some gusty winds at times moving the flag around. thanks to live television, the winds have backed off a little bit. now, they are starting to fire up. we are seeing a slight offshore breeze, north wind doing some very interesting things with our temperatures. much cooler on the coast where the fog is creeping up the coast. the winds, it is a battle of wind direction. north winds in the hill tops. a southerly breeze pumping up the low clouds heading out towards san francisco as we head into the afternoon. low cloud cover fills in off to our west. that's going to set off the ocean air-conditioning that will start to drop our temperatures as we head into tomorrow and thursday. inland, for one more day, focus in on the areas showing up in orange. north bay and east bay valleys,

passing lunchtime, mid to upper 80s. look at the cooling at 5:00 into san francisco. sea breeze reaching inland. a lot further than it did this morning. by tomorrow morning, we'll see some patchy low clouds and a few spots. much cooler by the time we get to thursday and friday. look at the big drop in high temperatures. then, skies will clear a little bit with some warming moving through the weekend. >> that road weather index we share on our maps, also sharing that wind as you are talking about. highway one tackling the bay. watch that along the coast. we are looking towards 101. these trucks you are passing by, not a problem. calm winds through san jose and a smooth drive. slowing north of 680. we will show you the map. the focus is right now from the bottom of your screen. clearing by the time you get into downtown. pretty smooth there. at the very bottom, you see where it says nbc. we have slowing for north 85.

dropped off in the bay area. san francisco's city attorney reviewing reports claiming rawson-neal psychiatric hospital in las vegas bussed about 1500 discharged patients out of town over the past five years. dennis herrera says at least 36 of those patients ended up in san francisco with nowhere to go and no plan for mental health care. they most likely ended up in already crowded homeless shelters or out on the street. taking advantage of our most vulnerable. putting them on a one-way ticket to somewhere with no support. they say, go he to san francisco, they will take care of you. which is true, we will but come on. >> the department health and human services is investigating the las vegas hospital. still ahead, a security scare at a california airport. we will tell you about the slip-up that sent people scrambling out of an international terminal. a racial profiling reversal, why a south bay police department may be backtracking on a revolutionary policy.

canadian authorities arrested two men they say wanted to carry out a major terrorist attack on a via rail passenger train from toronto to new york. this slid yo shows one of the

escovel is reversing this policy. i did reach out to the department spokesperson this morning. i have heard back in a text message. i did get a response. he says that escovel is working with his command staff to address this issue. that's the response we received this morning. here is the thirng. simply the idea that controversial practices that could bring back racial profiling is upsetting to people. this includes curb sitting. the naacp says it is a form of humiliation that unfairly targets minorities. it was instituted by former chief, chris moore. he required officers to document all stops and note their race and whether they were told to sit on a curb. we spoke to the naacp president. he wants escovel to rethink his move. >> we have expectations of him and the department to come

your day. if you like it cool, wait until tomorrow. >> san francisco, a very interesting view this rng month. we ha we have the fog to the west. golden gate bridge. north winds making breezy conditions around the hilltop. moving down out of the head lands, specially around napa, fairfield, santa rosa and livermore. close to 70. that's because we got dry, north winds at times reaching down into the inland valley locations and into san francisco. on the coast, low clouds and fog sweeping up. maybe not the best beach day, unlike yesterday. those low clouds will spill inland. in the case of our north bay hill tops in the east bay, winds moving in out of the north as the air drops down in elevation. it warms and starts to dry. humidity levels quite dry for morning hours. 13% humidity this time of morning. typically, we see the highest in the morning hours. not the case right now. relatively dryer air in those hill tops where those inland locations will still reach the mid to upper 80s today.

a little bit cooler around the inner bay, specially around san francisco and heading down the coast. more cooling come thursday. we will see temperatures dropping by almost 10-20 degrees compared to yesterday's highs. high pressure still in control have o our weather. no sign of any rain next 7-10 days. today inland, still some 80s. not quite as hot as yesterday. we are not looking at 90s on these maps. 85 degrees in pleasanton and 86 in fairfield where those north winds will continue. wind advisory through solano county through 2:00 this afternoon. 84, santa rosa. 70s around san francisco over towards oakland. our temperatures continue the cooling trend. a few more degrees tomorrow. a big drop in temperatures. it is going to feel pretty chilly by thursday morning. heading into the weekend, less of a sea breeze. just in time, warming up heading towards sunday. mike? look over here towards sunol, plenty of sunshine rob is talking about. these hills going to dry out. look at this, south 680, that's

what i'm talking about. around the bend, there is a golf course heading over the hill toward fremont, slow now. reports of some gravel as folks travel south bend and the build of the commute. let me show you the map. south 680, your commute direction out of sunol making that bend around the washington irving connection. reports of gravel. the trucks spilled some gravel over the roadways. a number of cars pulling over. a lot of clater that's going to be the case. from the sunol grade down towards mission, the potential for a lot of gravel. i don't know which lanes they are. it sounds like it is over to the right. a note from my brother coming out of the area. watch it. his car is very precious to him. looking over to the area of mission. looking slow. no problems for 880. a smooth drive. coming out of that, livermore, pleasanton. the build continues coming from 84. 580 looking pretty good. a lighter flow for 580 itself. that traffic going to cause that

slowdown as you travel through that zone approaching mission. south bay, capital. slowing for 101. building for 87 north. south of capital. i don't know what's going on. there is no crash reported. there is a good deal of storing for 85. that may be causing some slowdown off of that transition. no incidents reported here. i will continue to track that. now, in palo alto, along the peninsula. that moves smoothly. the only issue is coming down towards the sunshine. the visibility of problem as the sun peeks out through the trees. no problem for 580 or 880. approaching the toll plaza around west grand. back to you. 6:50. police are investigating an attempted murder/suicide in redwood city, just before 1:00 monday morning at a home on carlton court near woodside road. a 69-year-old man shot and killed his 72-year-old wife and then shot himself in the head.

the man is hospitalized in critical condition. a motive under investigation. an attorney representing the man behind one of bait area's most high-profile murder cases is now trying to keep her job. she stands accused of smuggling a hit list out of jail. christie smith is live in san francisco with the punishment she is now facing. good morning. >> reporter: good morning to you, jon. this story has so many twists and turns. today, attorney for the state bar association of california will ask a judge that attorney lorna brown bedy barred for allegedly smuggling a hit list out of jail on behalf of her clients. something like this is not taken lightly. apparently, less than 1% of all of california's attorneys were stripped of their licenses in 2011. it is only reserved for very severe cases of misconduct according to the tribune and the chauncey bailey project who are investigating this. she is a former attorney for the former head of the black muslim bakery in oakland.

county prosecutors there say the list was witnesses that would have testified against bay. he was convicted of ordering the murders of three men, including journalist chauncey bailey that was writing a story about the bakery they believe would be unflattering. brown admits that she took notes from bay and hit them but believed they were love letters to a girlfriend and other notes to his mother. the note was then found in the car of a felon who then described himself as bay iv's number one soldier. brown agreed to a two-year suspension. the state supreme court stepped in an rejected that. today's trial will focus on what the appropriate punishment should actually be. reporting live in san francisco, christie smith, "today in the bay." san francisco is helping to foot the $9,000 bill to care for a pitbull mix that attacked a police horse. 2-year-old charlie, bit and chased a parked police hoarses

long distance solar airplane getting all warmed up. good morning, bob. good morning to you, laura and jon, you are you can taing abta solar impulse. nasa, what they have been doing, they are actually starting on the left side. they have motors. there is less horsepower on this aircraft than in a scooter, by the way. that's what's going to be propelling this aircraft when it takes off around 7:00 this morning for a 16-hour nonstop test flight over the bay. it is getting its power from the solar cells that cover the very long wings. 12,000 solar cells on a wingspan wider than a 747. you see they are running up the other two engines, the other two motors. it weighs about as much as a small car. today, test flight is in preparation for next month's first cross country trip by a

solar airplane. it will be done in five legs. each leg lasting 24 hours. again, nonstop. powered by the sun during the day. solar-charged batteries at night. >> we need to inspire people, inspire people to achieve their dreams, inspire people to achieve the impossible, to get out of their servitude. so if we can bring this also for the young generation, that's the goal of this project. >> reporter: looking back live at the solar impulse here at moffatt field. the plane could make the stop nonstop but unfortunately, the pilot couldn't. there is only enough room for one man and one woman. two men that share the duties. obviously, they have to get some sleep at one point. right now, there is an autopilot on this aircraft.
